Brief Summaries Of Potential Penalties With BUI Convictions

Penalties depend on several factors, including prior convictions, minor occupants in the vessel at the time of the offense, any injuries or property damage, and/or an excessive blood alcohol content (BAC). Penalties for a BUI conviction in Florida vary depending on factors such as how many BUI convictions there have been and whether there were passengers under age 18 on board.

Penalties for a first offense may include $500–$1,000 in fines; up to six months in jail and/or probation and jail in combination for a maximum of one year; community service; impoundment of the boat. Higher criminal charges and additional penalties may result from a higher blood alcohol content (BAC); for having a minor in the boat; for causing property damage; and for serious injury or death to someone else.

For a second offense, penalties may include $1,000 to $2,000 in fines and a maximum of nine months in jail. Additional penalties may result if the BUI occurred within five years of a prior BUI or DUI conviction. Impoundment of the vessel may result in case of probation. Also, there may be additional penalties for a higher BAC or having a minor passenger on board.

For a third offense, penalties may include up to five years in prison and $5000 in fines.
